How to enforce school enrolment

This section outlines the process if it's suspected a child isn't enrolled in school.

These guidelines are for school attendance officers.

Enforcement stages

The stages of enforcement are:

  1. Receive a referral and make enquiries
  2. Send an enrolment notice and assess the response
  3. Decide whether to send an infrigement notice (a fine). Proceedings in court happen as a last resort.

The law

Enrolment laws are set out in the:

  • Education and Training Reform Act 2006, as amended by the Education and Training Reform Amendment (School Attendance) Act 2013
  • Education and Training Reform Regulations 2007.
