The Disability Standards for Education (the Standards) came into effect on 18 August 2005. The Standards seek to ensure that students with disability can access and participate in education on the same basis as other students.
The Standards clarify the obligations of education and training providers, and the rights of people with disability, under the
Disability Discrimination Act 1992 (DDA). The Standards are subordinate legislation made under the DDA.
A primary objective of the Standards is to make rights and responsibilities in education and training easier to understand. The Standards cover enrolment, participation, curriculum development, accreditation and delivery, student support services and elimination of harassment and victimisation.
Guidance Notes to the Standards provide additional explanatory material, including background information and comments intended to help people interpret and comply with the Standards.

Following the Review of the Standards undertaken in 2010, the Commonwealth Department of Education prepared a series of fact sheets on the Standards to assist student, parent and school understanding of them.
A suite of eLearning resources relating to the Disability Standards for Education 2005 has been developed by the University of Canberra and the education departments of all States and Territories.
The purpose of these resources is to provide a consistent national approach for assisting schools and education providers to understand their obligations under the legislation. These resources are also important to understanding the model applied to the Nationally Consistent Collection of Data on School Students with Disability (the Data Collection) in which all schools are required to participate from 2015.
All education providers are bound by the Standards: preschools and kindergartens (but not child care centres), public and private schools, public and private education and training places and tertiary institutions including TAFEs and universities.
