Fitness for duty

A principal or manager who has a genuine concern about an employee's capacity to undertake his/her duties may inquire into the fitness, capacity and efficiency of the employee to discharge the duties of his/position. This includes instances where the principal or manager:

  • considers that an employee’s work performance is being adversely affected by his/her state of health;
  • is of the view that an employee is unable to satisfactorily perform the duties reasonably required of him/her or fulfil the inherent requirements of the position;
  • has reason to believe that an employee’s state of health may make the employee a danger to other employees, themselves or other persons or is affecting staff morale to the point where the operations of the work unit are being affected.

It should be noted that an employee who ceases employment on the grounds of ill health may be eligible for disability benefits through the superannuation scheme of which he/she is a member.  In circumstances where an employee is considering ceasing duty on the grounds of ill health it is strongly advised that the employee contact their superannuation scheme. An employee is eligible for pay in lieu of long service leave after 4 years service where satisfactory evidence is provided that the retirement is due to ill health which is likely to be permanent.
