Industrial Awards
The following Federal awards cover staff employed in the Department:
- Teachers (Victorian Government Schools) Conditions of Employment Award 2001
- School Services Officers (State Government Schools), Victoria, Award 2000
- Victorian Public Service Award 2005
A Federal award prevails to the extent of any inconsistency in state legislation, regulations or ministerial orders.
Note that Section 57 of the Fair Work Act 2009 provides that a modern award does not apply to an employee in relation to particular employment at a time when an enterprise agreement applies to the employee in relation to that employment.
Non-departmental employees, such as Kindergarten Teachers and Assistants and Early Childhood Workers, should consult their employer regarding Federal awards applying to them.
