Fees and penalties

In line with Government policy and the Monetary Units Act 2004, all fees are now expressed in fee units.

It is also Government policy for fees to be automatically indexed each year on 1 July, the rate to be announced by the Treasurer. The Treasurer also publishes the value of a fee (and penalty) unit for that year.

The rate of indexation for the 2009/10 financial year is 3% and from 1 July 2009, the value of a fee unit is $11.69.

From 25 May 2009 the amendments to the Children’s Services Act 1996 and the new Children’s Services Regulations 2009 commenced. This has meant that there have been changes to the prescribed fees and penalties. Further information is provided below.

Table of fee amounts

As the Children’s Services Regulations 2009 (Regulations) do not express fees in dollars, a table is provided below that converts the fee units to dollar amounts.

Please note that as many licensing processes ask for forms and fees to be lodged in advance, applicants need to provide the prescribed fee with their licensing forms. Please check for the correct fees in the table below before sending off the application form.

Penalties

A range of penalties are identified in the Children’s Services Act 1996 (Act) and the Children’s Services Regulations 2009 (Regulations).

Non-compliances in relation to the Act and the Regulations attract penalties if the matter is prosecuted successfully in court. The court will determine the penalty, up to the maximum prescribed by the Act or Regulations.

While the maximum penalty points are set, the monetary value of the penalty is set annually by the Treasurer.

From 1 July 2009, the value of a penalty unit is $116.82.
