Education and Training Reform Regulations Review

​​​​​The Department of Education and Training (the Department) has reviewed the Education and Training Reform Regulations 2007 (the 2007 Regulations) before they automatically sunset on 26 June 2017. The Department has drafted the new Education and Training Reform Regulations 2017.

Independent Review into Privacy Breaches in April 2017

In April 2017, the Department inadvertently published some submissions into the proposed regulation changes against the instructions of the parties involved. The Department unreservedly apologises and has since conducted an Independent Review in this breach of privacy.

Notice of decision

The public consultation period closed at 5pm on 28 February 2017. The Minister for Education and the Minister for Training and Skills have announced their decision to make the new Education and Training Reform Regulations 2017. See: Statement of Reasons (docx - 66.3kb)

The Education and Training Reform Regulations 2017 will be tabled in Parliament in June 2017 and will take effect on Sunday 25 June 2017.

In accordance with the Subordinate Legislation Act 1994, a Regulatory Impact Statement (RIS) presenting a cost-benefit analysis of the proposed Regulations was prepared. See:

Stakeholder feedback was considered in the preparation of these documents.

Scope of the review

This review related to matters that could be dealt with in regulations, and did not include matters that would have required legislative amendment to the Education and Training Reform Act 2006.

The scope of matters that may be prescribed in regulations is outlined in section 5.10.1 of, and Schedule 5 to, the Education and Training Reform Act 2006.
