Education and Training Reform Act 2006

​​​What is the Education and Training Reform Act 2006?

The Education and Training Reform Bill was passed in the Parliament on 4 May 2006 and, following the approval of the Governor in Council, received Royal Assent as the Education and Training Reform Act 2006 on 16 May 2006.

The Act came into effect when it was proclaimed on Sunday 1st July 2007 by the Governor in Council. For more information about the Act, see: Education and Training Reform Act 2006​.

The Act represents an important and historic milestone - Victoria’s education legislation had not been reviewed since 1958, and some sections had been virtually unchanged since the establishment of the Education Act in 1872. 

The Education and Training Reform Act 2006 builds on the strengths of Victoria’s previous education legislation but also reflects the reality of contemporary education. Its main purpose is to set out a legislative framework that will underpin quality education delivery in Victoria, both now and well into the future. 

What will the new Act change?

From the beginning of the review process, the Victorian Government has been committed to developing new legislation that meets the community’s expectations for education. To ensure this, the Government consulted widely with education stakeholders, and the broader community, at every key development stage of the new legislation. 

Informed by the views expressed, and the Government’s own policy research, the Act includes a set of overarching principles upon which the practice of education is to be based.

Importantly, it requires all providers, both government and non-government owned, to deliver their programs and teaching in a manner that supports Australian democratic practices, including a commitment to:

  • elected Government
  • the rule of law
  • equal rights for all before the law
  • freedom of religion
  • freedom of speech and association
  • the values of openness and tolerance.

In addition, the legislation is underpinned by a commitment to diversity, choice innovation and access to education and training of the highest quality.

When will the Act come into effect?

The Education and Training Reform Act 2006 came into effect on Sunday 1st July 2007 when it was proclaimed.
