The Education and Training Reform Bill passed the Legislative Council of the Victorian Parliament on Thursday 4 May, 2006 and received Royal Assent through the Governor in Council on Tuesday 16 May, 2006 after a two year process of development and consultation.
The Education and Training Reform Act 2006 represents an undertaking by the Victorian Government to ensure that Victoria has a robust and modern legislative framework for education. It updates and replaces twelve separate education Acts.
The Act came into effect when it was proclaimed on Sunday 1st July 2007 by the Governor in Council.
Revised TAFE Institute constitutions
In October 2007, the Minister for Skills and Workforce Participation authorised the revision of all TAFE Institute constitutions to reflect the new Act.
Amendments to all TAFE Institute constitutions:
- ensured alignment with the requirements of the Education and Training Reform Act 2006
- reflect changes to State Government purchasing and tendering limits
- include specific amendments requested during consultation with individual TAFE Institutes
Orders in Council
A few sections of the Education and Training Reform Act 2006 provide that the Governor in Council has the power to approve certain matters. These matters must be dealt with by an instrument known as an Order in Council.
The way this works in practice is that the Governor of Victoria must exercise the power given to that office by legislation in accordance with the advice of the Victorian Executive Council. This Executive Council consists of at least two and normally four Victorian Ministers who meet with the Governor and represent the Government.

Examples of matters relevant to Skills Victoria and its stakeholders that must be given effect by a Governor in Council Order are:
- creating a TAFE institute
- establishing a Board to oversee and govern a TAFE institute
- setting the rate of payment for students employed under a practical placement agreement.
Under Section 5.1.3 of the Education and Training Reform Act 2006 once an Order in Council is made, it must then be published in the Victorian Government Gazette.
